Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ClaroCal (the “Service”), operated by Victoria Garland Creative Inc. (“we”/“us”). By using the Service, you agree to these Terms.

Promoting ClaroCal as an affiliate is governed by a separate, versioned document, the Affiliate Program Terms, which these Terms do not alter.

1. Accounts

You are responsible for the information you provide and for maintaining the security of your account. You must promptly notify us of any unauthorized use.

2. Subscriptions and billing

Paid plans are billed via Stripe. By subscribing, you authorize us and our processor to charge your selected payment method. Fees are non-refundable except where required by law.

3. Acceptable use

You agree not to misuse the Service, attempt to access data without authorization, or interfere with its operation.

4. Intellectual property

The Service, including software, designs, and content, is owned by Victoria Garland Creative Inc. or its licensors. These Terms do not grant any ownership rights to you.

5. Disclaimer

The Service is provided “as is” without warranties of any kind. We do not warrant that the Service will be uninterrupted, timely, or free of errors.

6. Limitation of liability

To the maximum extent permitted by law, in no event will Victoria Garland Creative Inc. be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

7. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service at any time.

8. Governing law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of laws principles. Venue and jurisdiction will be in the courts located in Ontario, Canada.

9. Changes

We may update these Terms from time to time. We will post the updated Terms on this page with an updated “Last updated” date. Your continued use of the Service constitutes acceptance of the updated Terms.

10. Text messaging (SMS)

These messaging terms apply if you link a mobile number to your ClaroCal account. Linking a number is optional and the Service works fully without one.

• Program: ClaroCal daily planning alerts, operated by Victoria Garland Creative Inc.
• Who we message: only the account holder, at a number they entered into their own signed-in ClaroCal account and confirmed with a one-time code we text to it. We never message a number obtained from anyone else, and consent is never bought, sold, rented, or transferred.
• What we send: a one-time verification code when you link your number, your morning briefing if you have it switched on, and replies to messages you text us. We do not send marketing or promotional text messages.
• Frequency: message frequency varies with your settings and how often you text us. Morning briefings arrive at most once per day.
• Cost: message and data rates may apply. ClaroCal does not charge for text messages, but your mobile carrier may.
• Stopping: reply STOP to any message to stop all texts. Reply START to resubscribe. Reply HELP for support information, or MENU for the list of things you can do by text. You can also unlink your number in ClaroCal settings at any time.
• Privacy: no mobile information is shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy and our SMS opt-in page.
• Support: support@victoriagarland.ca.
• Carriers are not liable for delayed or undelivered messages.
